Terms of use for the linking and use of IDM NAVIGATOR control with Amazon Echo and Alexa APP
These terms of use apply for the linking and use of the NAVIGATOR control with Amazon Echo devices which are controlled via Amazon’s Alexa app and for which so-called “skills” (various pre-defined voice control options) can be activated.
Subject matter
IDM provides an interface for the use of Amazon's Alexa app (“Alexa”) to the users of an internet-capable NAVIGATOR control. With the Alexa app, which is currently available for Fire OS, Android OS and desktop browsers, the user can easily install and manage the Amazon Echo (“Echo”) device which can be separately purchased from Amazon. Alexa is a web-based service that also provides its users with the option to link and manage various third-party products through the available “skills” of these products. Alexa is available for download at www.amazon.de or from the Apple app store or on GooglePlay in accordance with the applicable Amazon terms of use.
Amazon is the service and product provider of Alexa and Echo. You can find the respective information regarding the Amazon Group branch or company that offers this service on https://www.amazon.de. To use Alexa in connection with IDM products, the user must individually register with Alexa and login. In addition, the user needs to individually purchase a device compatible with Alexa, e.g. Echo, and configure it.
For the use of Alexa and Echo, only the Alexa and Echo terms of use apply as well as Amazon’s Privacy Policy, which can be found at www.amazon.de or the respective app store. The user can use the Alexa and Echo interface via his/her existing access to myIDM.
By using the interface and via the skills which are linked with Alexa and Echo, the user agrees to these terms of use and to the IDM Privacy Policy.
IDM services
IDM provides the link to Alexa and Echo via pre-defined skills. Alexa and Echo are Amazon Group products, a provider that is independent from IDM.
IDM is not responsible for the product offering and services of Amazon Alexa and Echo and does not assume any respective liability. By providing the interface and skills, IDM merely provides users with the option to link select IDM offerings with Alexa and Echo product offerings.
IDM has no influence on the type and content of the Alexa and Echo or third part product offerings that can be linked to the IDM product offering via Alexa and Echo.
The interface will be provided free of charge via the internet for the time being. IDM can suspend providing the interface and skills following a reasonable notice period or immediately in the event of justified concerns regarding data security or due to mandatory legal requirements. The notification can be sent via the respective IDM account or via email.
IDM does not provide any warranty, guarantee or claims of characteristics relating to the use and availability of Alexa and Echo, the unchanged existence of Alexa and Echo and the linked skills, their functions or interfaces provided by Alexa and Echo.
IDM has programmed its interface according to the state of the art, but does not make any assurances regarding the absence of errors or accuracy of the results, or their usefulness for the user in general or for a specific purpose.
A prerequisite for the use of the skills linked with Alexa and Echo is that the Alexa product offerings and the Echo system and potentially required third-party services are available and that an active internet connection exists between the participating offerings, services and devices. IDM offers the linking of the skills to Alexa and Echo only to users in selected countries and certain language versions. Further technical prerequisites may result particularly from the user notes in connection with the provision of the product offering.
Liability
To the extent that information, software or documentation is provided free of charge, IDM is not liable for any material and legal defects in the information, software and documentation, particularly concerning their accuracy, correctness, freedom of third-party property rights and copyrights, completeness and/or usability – except in case of intent and malice.
Aside from this, IDM assumes no liability, unless liability is mandatory according to, e.g., the product liability law, or due to intent, gross negligence, loss of life, bodily injury or damage to health, or due to the acceptance of a quality guarantee, fraudulent concealment of a defect or due to the breach of material contractual obligations. Compensation for damages due to the breach of material contractual obligations, however, is limited to contract-typical, foreseeable damage, to the extent that intent and gross negligence can be excluded.
Although IDM will always strive to keep IDM products free of viruses and any other malignant code, IDM cannot provide any guarantees in this regard. Before downloading any information, software and documentation, the user must employ appropriate safety measures and virus scanners for his/her own protection and to protect him/herself against potential malignant code in the IDM products.
A change in the burden of proof to the detriment of the user is not connected with the provision above.
User obligations
The user is not permitted to use the interface and the skills with Alexa and Echo for illegal activities, or misuse them in any other way which would jeopardize, adversely affect or make impossible the use of Alexa’s, Echo’s and IDM’s products by third parties.
In connection with the use of the interface, the user will in particular
- not attempt to gain unauthorized electronic access to the property, facilities or devices of third parties of third-party user accounts;
- not permit third parties and not help or support third parties in their attempts to gain unauthorized access to Alexa, Echo or IDM product offerings;
- keep his/her user name, password and other information, intended to access Alexa, Echo and IDM product offerings, and the interface secret;
- notify IDM without delay if the user becomes aware or suspects that third parties have used the login information without authorization to gain access to IDM services;
- not use any devices, software or other means to disrupt the proper functioning of the IDM interface and skills related to Alexa and Echo.
If the user violates the aforementioned obligations or any other statutory or contractual obligations regarding the use of the service offered here, IDM has the right to block the respective user account and/or temporarily or permanently block the user's access to the services and the interface.
Final provisions
The terms of use are subject to Austrian law.
We reserve the right to change these terms of use within the scope of applicable law and subject to your rights as a user.
